Register a Trade Mark in China Just For £600, Chinese Trade-Mark Registration Online

Online trade mark registration in China services: why trademark registration in China with Coddan is important? Trademark registration in China is important for two main reasons. Firstly, piracy and breaches of intellectual property laws are rife throughout the country, so it's necessary for your company to try and fight this. Secondly, China's trademark system operates on a "first to file" basis. This means you have to make sure your trademark is registered in order to have any kind of trademark protection. If you don't have trademark protection, somebody else could register your proposed trademark and stop you from using and registering it.

Even if you're not selling your goods in China and are only manufacturing them there, somebody else could (and most likely will) register your trademark. This will then prevent you from exporting any of your goods from China that have the trademark on it (unless you pay a fee for licensing). This is a common occurrence in China and usually happens to businesses from countries that have common law "first to use" trademark registration systems.

This all means that you need to make sure your trademark is registered before someone else does it first. So ideally, you should register your trademark before you even begin to use it in China. If you think you're going to be using your trademark in China, there is nothing to be gained by waiting to register.

Another reason to file your registration as soon as possible is that the Chinese trademark office can sometimes take years to issue your trademark. While your application is being processed, you can't be stopped from using the trademark you applied for, but you will not be able to stop someone else from using it too.

Registering a Trademark in China: Why Register Your Trademark in China?

Register a Trademark in China

Why register a trademark in China? Your company should register its trademark in order to protect your reputation and image. Registering your trademark means no one else can use it without your permission. Your trademark is a symbol of your company and everything you have built; if unauthorised people use it, it will be putting your hard-earned position at risk. Registering it gives you extensive legal protection in order to prevent this from happening. It also gives you the peace of mind that you're not infringing on anyone else's trademark.

Registering your trademark in China is a good idea if you want to trade or manufacture there. The population's sheer size means that there will always be the potential for unlawful third-party activity.

Also, China uses a "first to file" system, so whoever files the registration for a trademark first will get the trademark. So it's important that you register your trademark as soon as you decide you want to operate in China. The registration will only cover you in China though, so if you wish to use the trademark in other countries, you will need to file separate registrations.

At Coddan, we offer comprehensive trademark registration services in China. You can provide us with all your trademark and a limited company, or a limited liability partnership information and we'll take care of the whole application process. Trademark Registration Process in China

Trademark Registration Process in China

Trademark registration process in China: companies all over the world are clamouring to get into China's massive market, but in an enormous country with a booming economy, there are inherent risks such as counterfeiting and trademark infringement. If you're considering China as a market for your company, you will need to ensure your trademark is first registered there, to give you legal protection should rival firms try to copy it.

Trademark registration in China is handled by the Trademark Office of the Industry and Commerce Ministry in Beijing, and you can make an application online - however, the forms are in Chinese as it's the only language accepted, and are complex, so you may not be able to. Here at Coddan, we're happy to help you make the application, so that it's done properly and you get your trademark approved and protected.

The types of trademark allowable in China include those composed of words, letters, numerals and symbols and other designs, now also including three-dimensional designs. In addition, any kind of color combination may be used in the trademark. Those that are not permissible and will be rejected by the Trademark Office are trademarks similar to existing registered ones and proposed trademarks bearing the names of countries and other companies and organisations.

China has adopted the International Classification System, so when applying for a trademark and describing your company's products or services with the Trademark Office, you'll be able to choose between 24 categories of products and 11 for services. If you have more than one product or service, however, you'll need to make separate applications.

The proposed trademark must be submitted on paper and in a certain size, and if it's colour there will need to be five copies, and one for black and white. Various documentation must be provided, including a power of attorney letter, and if they're in a foreign language, such as English, they must be submitted along with a translation in Chinese.

If the trademark is approved, it will be valid for 10 years from that date, and renewals are valid for the same period. Applications for renewals must be done at least six months prior to expiry, but there is a grace period of six months from the date of expiry. If no renewal application is received by then, the Trademark Office will cancel it.

Benefits of Registering a Trademark in China

Benefits of registering a trademark in China: there are many benefits when it comes to getting your trademark registered in China: -

1. Having a registered trademark means you will get the exclusive right to use it. After you've registered your trademark in China, you'll be given documentation as proof of ownership. When you've received this, you will have the exclusive right to use your trademark in China, on all your company's products.

2. Having a registered trademark means you can take legal action if infringement occurs. Following your trademark registration, you will be able to take legal action if anybody uses your trademark without your consent. It also stops other companies from registering a trademark that is the same or very similar. In China, without your trademark registered, you can't take any legal action.

3. Having a registered trademark means less stress. Once you've got a registered trademark, you can put your mind at ease because you'll know you'll be protected if another business tries to use it. There will also be less worrying about infringing on someone else's trademark accidentally.

4. Having a registered trademark means you will be able to use the ® symbol. Using the ® symbol is an offence if you haven't registered it as a trademark. When you have your registered trademark though, you will be able to use the ® symbol alongside your company's trademark. This symbol acts as a warning to others against using your trademark and helps give your business a better image.

5. Having a registered trademark is a huge asset. A registered trademark represents the brand and reputation of your company, and sets you apart from your competitors. It's also a fantastic company asset that can be used in the event of a company valuation for a potential M&A or initial public offering.
